      Book Description

      The growth of national economic regulation and the process of globalisation increasingly expose international transactions to an array of regulations from different jurisdictions. These developments often contribute to widespread international contractual failures when parties claim the incompatibility of their contractual obligations with regulatory laws.

      International disputes of such a nature inevitably involve both public and private law and raise questions about jurisdiction, applicable contract law, economic regulations and their legitimate international application. The author challenges conventional means of dispute resolution and argues for an interdisciplinary approach whereby disciplines such as international economic law, conflict of laws, contract law and economic regulations are functionally united to resolve international and multifaceted regulatory disputes. He identifies the normative foundation of contract law as an important determinant in this process, contending that contract law is essentially neutral and underpinned by the concept of corrective justice, while economic regulations are mainly prompted by distributive justice.

      Applying this corrective/distributive justice dichotomy to international contracts, the author critically assesses major conflict of laws approaches such as `proper law', `the Rome Convention' and `governmental interest analysis', which could disregard either public interest or private rights. The author, taking these theories into account, proposes an alternative two-dimensional interest analysis approach. He tests the viability of this approach with reference to arbitral awards and court decisions in various jurisdictions and concludes that it uniquely fits into the structure of international commercial arbitration. In adopting this approach arbitrators would take into account both corrective and distributive justice, and to the extent that corrective justice prevails, would be able to avert a total failure of the contract.

      What a joy to read this book. LEADING CONSCOUSLY reads like poetry rather than the analytical mess that most leadership books turn out to be. My favorite Chapter of this book is called, Natute's Manuscript. This work is very original both in content and in style. A must read for readers who are fed up of all-American leadership books.

      This is a must read book. The author gives us a radically different interpretation of leadership than what I have encountered so far.           If you have any questions about getting to retirement wealthy in Canada this book is for you. Cork takes you through every possible investment avenue you could think of, well there are a few others but for the sake of legality we won't mention them,and he breaks them down so even the most none investment literate person can follow. His sense of humour throughout doesn't allow the topic to get stale or dry. I read this whole book once through in 4 hours and have read it many times more. I now have a solid portfolio starting and I only have this book and Kevin Cork to thank.

              There are many books by do-gooders claiming to advance the wisdom and worldliness of Native American elders, but such books tend to glamorize the mythical past and/or simplify belief systems through the eyes of an amazed know-it-all white person. Another side-effect of the American media's obsession with Native American history is that it ignores the people's modern travails while focusing on how noble and pure everything was before the white man arrived. In this generally outstanding book, Kent Nerburn tries to avoid these weaknesses of white-generated coverage of Indians, and is mostly (though not always) successful.

              This book is based on Nerburn's very rocky and uncomfortable friendship with an old Lakota man named Dan, who has led a long life of hardship on the reservation while striving to preserve his tribe's culture and customs. Refreshingly, Dan and Nerburn quickly dispense with historical myths and focus on where Indians stand in the present, with modern social problems combined with a need to understand a history far more painful and destructive than even the most sympathetic White Americans could imagine. Nerburn cannot always avoid sappy cultural ruminations and Dan is not always a likable person - but this all works to the book's advantage because both are revealed as complex humans with realistic strengths and weaknesses. The text occasionally gets uncomfortable as Dan delivers hard-hitting soliloquies on the continuing differences in the worldviews of the two peoples, but his opinions on matters of history and culture can be highly illuminating, as are Nerburn's struggles to understand without becoming the type of exploitative writer that he loathes. In the end, this is an extremely thought-provoking book and is essential for anyone interested in the culture of Native Americans - yesterday and today. [~doomsdayer520~]

              I am in the process of reading this book for the third time, and it still catches and holds me like very few other books can. If you are a reader interested in obtaining a dramatic and unadulterated view of America through the eyes of those who lived here prior to the European invasion, this book will give that to you. If you want a viewpoint beyond the white-written history books, in which battles won by Indians are "massacres" and battles won by whites are "victories," this is the book for you. After all, this was a country in which people and societies existed before Christopher Columbus showed up. I will warn you to be prepared; you will never view "American" history in the same manner again!

              A fantastic, insight into a reality we share with native americans - Our country and lands, democracy, religion expanded just behind our destruction and sanctioned genocide of the American Indian. A gripping reminder that 150 years, in the collective memory of a people,is but a blink of an eye and that this struggle that most White Americans relegate to old hisotry is still well alive for Native Americans. This history,our own history, if held to contemporary american moral compass would be the cause of great outrage. As I read I found my patriotism humbled by they hyprocracy of our own history. And yet, the message of the book also faces the reality of the past and looks to a better future both for Native and White Americans. Simply a great read and great insight.

                      Despite his importance Webster has never been the subject of a full-scale, scholarly biography. Maurice C. Baxter's One and Inseparable traces the interrelated evolution of the public career and the private life of this imposing and controversial Yankee. He portrays Webster as an unswerving patriot, an advocate of nationality, and a champion of peace and the Union--but also reveals him as a self-promoting politician who varied his positions to suit the interests of his constituents and was sometimes insensitive to the great moral issues of his day. This devoted family man, enterprising if not altogether successful farmer, and genial companion could he egotistical, immoderate in his drinking habits, and careless about personal finances. Reading Baxter's lucid, moving biography it is possible to understand why Ralph Waldo Emerson so detested Daniel Webster but also called him "the competest man" produced by America, adding: "Nature had not in our days, or not since Napoleon, cut out such a masterpiece."

It covers his youth in Philadelphia, his development as a writer and magician, his wives, including the third, (Litzka, who was a harpist and magician in her own right), his time living in Maine and upstate New York, and his later years and death.

                          In addition to being credited with creating The Shadow (he used the pseudonym Maxwell Grant), Gibson wrote 187 books, contributed 668 articles to periodicals, created 283 stories for The Shadow Magazine, wrote 48 separate syndicated feature columns, reported the adventures of The Shadow and Blackstone the magician in 394 comic books and newspaper strips, and helped develop 147 radio scripts and many other works under numerous pseudonyms. Gibson has invented many widely used magic tricks and traveled with and befriended Harry Houdini, Howard Thurston, Harry Blackstone, Sr., and Joseph Dunninger.

                          Possibly because of the format I thought that this book was going to be like many of the pulpateer biographies out there with a lot of rehashed stories and not much of anything else. But his one was realy entertaining. No scholarly disertation by a fanboy trying to make us think he is a professor and yet contains all the relevant facts about a writer whose life is as mysterious as his characters.

                          This book is great for Shadow fans, so grab this one before it goes out of print(as most other Shadow related books are)! There is plenty here for the seasoned Shadow fan, and the newcomer too. Pulp covers are reproduced in black and white, as are the various photographs of Walter Gibson. The biography is written in a clear,easy to read style, and is very informative.

                          Walter B. Gibson is a very overlooked cultural influence in America, arguably even to this day. His Shadow character captured the imagination of a generation, and even spawned a movie (with a too watered-down plot) in the early 1990's. So much Shadow lore is available out there - comics, radio shows, and novels - but many overlook the profound effect of Mr. Gibson, who is entitled to a cult following similar to that of HP Lovecraft or Robert E. Howard. I give this book 4 stars because of the price - it should be about 15 dollars cheaper.

                            Not as good as the first, as a little slow in the middle, however, the start is interesting, sinister bad, guy, death trap, and the Shadow fights an ape-man at the end, on a ledge. An interesting SF note is that The Shadow uses television, in 1931, so watch some of his assistants, to improve on his 'portable wireless set'.

                            We also get to see him in his Lamont Cranston identity and see that it is pretty definitely him.

                                          Growing up in Brooklyn certainly has it's own cachet, but I, a female, growing up in Massachusetts at the same time as E B, found so much that was familiar. The book is a wonderful treatise on growing up anywhere, but E B and his friends are so special that I didn't want to finish reading it. It was a splendid "read".

                                          Gave a great deal of insight into the development of friendships and lifetime committments. "Bobby saves Jerry" and they remain friends for a lifetime. Just beautiful---Would love to see a sequel to this book. Interested in knowing the stories of the characters as they matured, including their successes, joys, heartaches and disappointments.

                                          I grew up in a small town, but I married a boy from Brooklyn who went to St. Vincent Ferrer. For 40+ years I have heard the stories of that life and those times, and it was a thrill to have it all documented is such a charming and factual manner. Bert Kemp put on paper what my husband has told me through the years.

                                          The book really took me back I grew up in East Flatbush in Bklyn in the 50's. It was a little before my time but I did remember alot of the places he talked about. I recommend this book to anyone it is fast reading,enjoyable and you just feel like your part of EB's many friends. I just emaied a few of my old friends an am passing the book on to one of them and telling the rest to go out an get a copy you won't be sorry. I wish there were more books like this out there I tell my children all the time about how great it was to grow up the 50's.

                                          EB exceeded all of my expectations, and I am a very discriminating reader. It's a charming memoir of a very special time, and of a group of kids that everyone can see a part of themselves in. The backdrop of Flatbush, Brooklyn of the 40s and 50s adds a wonderful, nostalgic touch. How great to read something touching and good in today's times of turmoil and questionable ethics. I recommend it whole-heartedly.
