The laws covering intellectual property--those products of the imagination with commercial value, such as fictional writing, software designs, product names, and mechanical inventions--have long boggled the minds of the uninitiated. With the advent of online commerce and publishing, the issues have only gotten more confusing. The new edition of Patent, Copyright & Trademark: A Desk Reference to Intellectual Property Law, by attorney Stephen Elias, offers plain-English explanations and practical advice on this increasingly complex topic. Elias covers everything from the laws themselves to their specific applications in different media.

    Book Description

Whether you're an Edison, Faulkner or Gates, you need Patent, Copyright & Trademark.

Intellectual property law has rapidly produced its own language. But don't count on understanding it right off the bat -- the language baffles lawyers and lay folk alike. Whether you're an inventor, designer, writer or programmer, you need to understand the language of intellectual property law to intelligently deal with such issues as:

*who owns creative works or valuable information
*how these owners can protect and enforce their ownership rights
*how disputes between intellectual-property owners can be resolved
*how ownership rights can best be transferred to others
    *and many more

With this essential guide, you will:
*get clear and concise overviews of patent copyright, trademark and trade secret law
*understand the different kinds of protection offered by patents, copyrights, trademarks and trade secrets -- and which apply to your work
*get a plain-English definition of every term you're likely to come across
*find the information you need, quickly and easily -- all entries are organized by topic and extensively cross-referenced

The updated 5th edition covers the application of the Digital Millennium Copyright Act in U.S. v. ElcomSoft, freelance writers' ownership rights as established in New York Times v. Tasini, the Supreme Court's controversial ruling on patents and doctrine of equivalents in Festo Corporation v. Shoketsu -- and more!

    4 out of 5 stars Great Resource.......2007-09-08

Excellent follow-up to the previous Nolo editions. Layout of the book was not as graphically pleasing, but the information is straightforward and well presented.

1 out of 5 stars The book is subpar.......2006-09-24

I bought this book as a primer reference to patents. What I got was a dictionary of words. This book pretty much is a dictionary without a lot of explanations. Really basic terms also. A lot of basic paraphrasing instead of actual text from the 35 USC manual.

5 out of 5 stars Legal Information without the Legalese.......2006-03-11

This book is easy-to-use and highly detailed with an appealing, bulleted layout and many illustrations that helped to answer most of my basic questions about the four categories of intellectual property (copyright, patents, trademarks and trade secrets). I took a graduate-level library science course on the legal aspects of information and borrowed several books on IP from the library. This Nolo Press book was the one that I kept coming back to and wound up buying. I was glad I waited for the updated 7th edition, which now includes an index. The book is divided into completely logical sections on definitions, statutes, forms and an overview, all of which make this book a joy to read. The text is written in plain English and the entries are cross-referenced and other resources are given. This is a legal book written by lawyers, but the legalese is edited out and only very useful information remains. If you need one basic legal reference book on IP, this is the one you'll keep reaching for.

    4 out of 5 stars Very Good.......2004-09-10

This has a lot of detail and organized information that a patent applicant might use. However, it does not provide an overview quite as well as something like "Patents for Beginners" (PfB). For patent applicants, I would recommend getting both books, but someone like a jurist or an expert witness might be better served by PfB.

5 out of 5 stars Useful Overview of Major Areas of Intellectual Property Law.......2003-09-02

Having worked in the field of intellectual property for over 30 years and as an attorney, I was interested to see what other attorneys would decide to put into a desk reference on the subject. I was pleasantly surprised.

Most business people I meet have a minimal understanding of intellectual property law. As a result, they make fundamental errors that could be easily avoided with a simple foundation in the law. But I didn't know of any place where they could get such a foundation until I read this excellent reference guide.

Many law students would probably also like to have a simple reference to give them a background in the subject before they start taking courses in the subject. Most attorneys also do not have any law school training in the subject, and they will also benefit from using this reference.

I was particularly impressed that the cost was modest for a legal reference.

The basic subjects are trade secrets, copyright, patent and trademark law. In all but patent law, a lay person can make many of the right moves in establishing rights without too much legal help. Patent law requires legal guidance in most areas, but a lay person can also avoid mistakes by understanding some of the common pitfalls that people fall into.

I was particularly pleased to see that trade secrets were covered well. Most business people do not realize that trade secret protection is often superior to that of copyrights, patents and trademarks. But you have to follow the rules, or your trade secret isn't going to be considered one. I only find about one business person in a hundred who is familiar with these rules.

Most people will also improve their copyright protection by following this guide.

In patents, it's very important to document what you've been doing, and I found those references to be very well done.

As to trademarks, most people misunderstand what can be trademarked and this book clears that point up quite well.

So think of this book as more than a self-help guide and less than a legal horn book. Naturally, the intricacies of appellate cases aren't fully exposed, but there's enough here to raise fundamental issues in your mind. In each area, you will see sample forms and documents along with directions for how to obtain and file them.

Nolo also offers an on-line reference that updates the material in this book, so you don't have to take out an extra subscription like most legal sources require.

In doing your legal planning, be sure to look at the guide on pages 9-11 to see what forms of intellectual property protection may be available to you. That guide is worth the price of the book alone.

I was also impressed by the extensive definitions in each subject area. Be sure to read through them all. Without a legal background, you won?t know what you don?t know unless you check these out. Naturally, the primary statutes are also included, for those who do not know how to look them up.

People who are new to these subjects will also benefit from the many references to other sources, including on-line databases.

I would advise anyone who tries to differentiate themselves through intellectual endeavors to use this guide to become familiar with the basics of the law.

After you finish reviewing this book, I suggest that you spend the time to think through how you can strengthen you legal protection of your most valuable forms of intellectual property.

Most books about career advancement are either weighty examinations about success in the workplace (e.g., How to Be a Star at Work and Working with Emotional Intelligence) or flippant, humorous takes on surviving the countless inanities of modern work life (e.g., Working Wounded). Jeffrey Fox's book, How to Become CEO: The Rules for Rising to the Top of Any Organization is neither. Instead, Fox presents 75 commonsense rules about successfully conducting your career.

Rules like "Know Everybody by Their First Name" and "No Goals No Glory" may seem obvious; others, such as "Don't Take Work Home from the Office" or "Don't Have a Drink with the Gang" may not. Each is accompanied by page or two of succinct and thought-provoking explanation. For example, for rule 27, "Don't Hide an Elephant," Fox writes, "Big problems always surface. If they have been hidden, even unintentionally, the negative fallout is always worse. The 'hiders' always get burned, regardless of complicity. The 'discoverers' always are safe, regardless of complicity." Wise and to the point, How to Become CEO will help just about anybody's career, whether you want to become CEO or not. --Harry C. Edwards

"How to become CEO" should be mandatory reading for anyone considering climbing to the top. I agree with almost all recommendations in this book. That is why, I must have given at least 20 copies as a present. The best part is; you can go back and read the chapters randomly once in a while to refresh the basic rules. I have also read the other books of the author, liked most, but this one is by far my favorite.

    5 out of 5 stars Excellent Book.......2006-06-19

I recently bought this book....I will recommend it to all the ambitious people out there. This is an awsome book....I am very impressed by all the things author has listed in the book.

Cookbooks about Tuscan cuisine abound, but the food of its easterly neighbor, Umbria, remains mostly unexplored. Mary Ann Esposito's Ciao Italia in Umbria meets this dearth handily. A "traveling cookbook," it showcases the region's healthy, rustic food while providing a first-person look at its restaurants, home cooks, and singular occupations, like truffle hunting. The core of the book--an offshoot of Esposito's PBS series Ciao Italia--is its 60 easy-to-do recipes, which feature the area's most notable and delicious products, including olive oil, black truffles, farro, and wine. If the relatively few formulas provided leave readers hungry for more, those offered, such as Carp with Rosemary and Fennel and Fava Beans with Olive Oil and Pecorino Cheese, couldn't be more inviting.

The recipes grow from Esposito's narratives. For example, her truffle hunt chapter yields the traditional Penne with Truffles and Cream as well as the more singular Veal with Black Truffle and Strawberry Sauce. Similarly, a section on local female chefs leads to two unusual gnocchi recipes--prune- and zucchini-filled--while one on Umbrian flatbreads offers formulas for oil-fried brustengo, spinach-filled torta sul testo, and a luscious prosciutto pie. Seafood is well represented, as are recipes for the pork delicacies of Norcia, including the delicious Sweet Pork Sausages with Grapes. Readers will also enjoy making sweets like Chocolate Spumone, exemplary strufoli (honey balls), and addictive mezzalune, almond crescent cookies. With an "address book" of outstanding Umbrian restaurants, the book provides a compelling culinary tour of a region too often neglected by cookbooks but, happily, celebrated here. --Arthur Boehm

    Book Description

Known as the Green Heart of Italy, the central region of Umbria, just to the east of Tuscany, is largely unspoiled by the modern world. Mary Ann Esposito loves the foods, traditions, and people of Umbria so much that shes devoting the entire 2002 season of Ciao Italia to it. In this intimate, passionate traveling cookbook, Esposito takes readers through this lush, mountainous, and tradition-filled region, with 60 recipes for its healthy, rustic food, profiles of its welcoming people, and an intimate tour of its food markets, home kitchens, vegetable gardens, wineries, and restaurants.Fans of Mary Anns show as well as anyone who loves the top-notch Italian olive oil, wine, black truffles, vegetables, and country breads will be transported in this very special book.

I bought this book after seeing Mary Ann Esposito's TV cooking show. We had also recently been to Umbria and had had many great meals. I was disappointed in the book. Not that many good recipes. Some of the items she prepared on the show are very good but the majority are not appealing. I am still looking for a better book on Umbrian recipes.

Maximizing one's savings is the surest way to guarantee that there is life after taxes. The truly successful investor begins with careful tax planning, which must never be a last-minute scramble in the dreadful month of March or worse still, April! We all know that few of us actually plan well ahead, as we ought to, to protect ourselves and our hard-earned money. This book may well be the answer. Based on The Gasletter Collection, the author's successful primer on sheltering your income, After Taxes is designed to help the working individual put in place a long-term strategy. An easy-to-understand handbook, it helps the reader wrestle with the implications of retirement funds, savings, off-shore shelters, investments, mutual funds, real estate, buyouts, separation allowances, and golden (or not-so-golden) handshakes. A must for those who wish to make informed financial decisions and better choices to guarantee a secure future.

This is one of the volumes in the "The Ultimate Series" published by Capstone Publishing Limited. Previously, I reviewed Des Dearlove's The Ultimate Book of Business Thinking and Stuart Crainer's The Ultimate Business Library. The three volumes comprise an especially informative and valuable resource for busy executives as well as for those now preparing for a business career. The nature and extent of coverage of "the most strategic ideas of all time" and of the sources in which they were introduced are remarkable. For example, during the course of a 192-page narrative, John Middleton provides a briefing on a total of 50 primary sources, arranged by author in alphabetical order (from Igor Ansoff to Shoshana Zuboff) but Middleton also offers other material that, all by itself, is worth far more than the cost of this book:

"Introduction" [Note: One of the most informative I have encountered thus far.]

"A Brief History of Strategy" which includes a comprehensive timeline that begins with the pre-history of strategy (e.g. Sun Tzu's The Art of War), proceeds through a four-decade period from 1960, and concludes with six works published in 2000. Middleton also identifies a number of key themes.

[Sequence of analyses of "the most strategic ideas of all time" and those who devised them, Pages 3-192]

              "Coda: The Future of Strategy"
              Annotated Bibliography
              Glossary of Strategy Terms

I like the various reader-friendly devices that Middleton uses so effectively throughout his narrative such as highlights of key points (e.g. Robert Baldrock's in The Last Days of the Giants?), brief excerpts (e.g. from Michael Hammer and James Champy's Reengineering the Corporation), "Zeitbites" (e.g. taken from Kenichi Ohmae's The Mind of the Strategist), summaries of key components within a methodology (e.g. Peter Senge's as developed in The Fifth Discipline and The Dance of Change), and "nuggets of wisdom" (e.g. from Sun Tzu's The Art of War). These and other reader-friendly devices energize what would otherwise be a solid but somewhat ponderous narrative.

To sum up, Middleton offers 50 different responses to an especially important three-part business question: "Where are we now, where do we want to go, and how do we get there?"

Those who share my regard for this book are urged to check the other two volumes in the "The Ultimate Series. " To supplement the sources that Middleton recommends for further reading on the subject of strategy, I presume to add Enterprise Architecture As Strategy: Creating a Foundation for Business Execution co-authored by Jeanne W. Ross, Peter Weill, and David Robertson as well as Dean R. Spitzer's Transforming Performance Measurement: Rethinking the Way We Measure and Drive Organizational Success, Lawrence Hrebiniak's Making Strategy Work: Leading Effective Execution and Change, Thomas H. Davenport and Jeanne G. Harris' Competing on Analytics: The New Science of Winning, and Jack Alexander's Performance Dashboards and Analysis for Value Creation.

                5 out of 5 stars A delightfully amazing read!.......2002-08-05

Helen Taber's account of her joyous childhood in Western Oregon is told in such a descriptive way that the reader is there in the story, living it along with Helen. It is hard to imagine more hard-working, nurturing, ingenious parents. Despite the rigor of life during the 1920s and 30s (perhaps due to it in part), they helped their children develop self-reliance and an unyielding curiosity about the world around them. I looked forward to my nightly reads and hated to reach the end of the tale.
