This book examines the problems of choice of law relating to shares and other securities. It is a subject that occupied a fairly obscure corner of conflict of laws until the impetus given to it by Macmillan v Bishopsgate Investment Trust (No 3) and recent interest generated by fears within the international financial community that the conflicts problems arising from the modern system of securities holding through intermediaries threatens the system's viability. At both European and international levels, efforts have been made to legislate for certainty in an area of the greatest practical importance to the major players in the capital markets, as the value of cross-border transactions in such securities runs into billions of pounds daily. Shares and Other Securities in the Conflict of Laws is divided into two parts. Part I determines the present state of English law with respect to choice of law treatment of dealings in shares, and examines the basic rules involved. It considers the context in which the rules have evolved, the situations in which they are said to apply and have been applied, and the place of the rules in the conflicts treatment of securities transactions today. The main focus is on dealings with shares in the traditional direct holding system from which the basic rules developed. Part II considers the difficulties associated with the application and extension of the basic rules to the choice of law issues that arise in the indirect holding system, the various theories and legislative reforms (of the EU and at the Hague) that have been suggested in respect to their resolution, and the extent to which they provide a viable solution. Comparison is also made with the related law reform initiatives in the US of Revised Articles 8 and 9 of the Uniform Commercial Code. The book concludes with an examination of special choice of law concerns in insolvency and arising from collateralization (such as perfection and recharacterization), the impact of dematerialization and immobilization on shares, and the choice of law problems posed by them.

If you have heard Eileen McDargh speak, you know that high energy, bouncy spirits, integrity, and experience somehow find a balance and produce wisdom of the heart that also speaks to the head. The Resiliant Spirit captures in words that same balance and makes it available in accessible language. There are a lot of self-help books out there but this one actually helps the self. I loved reading it and was frequently touched by McDargh's optimism which never surrenders realism or mature wisdom to be encouraging.

This little book of appetizer recipes is written with flair. The author obviously had great fun writing the book, and, just as obviously, has great fun creating her recipes. A friend and I created seven of these tasty treats for an anniversary party - the recipes were easy to follow, and the appetizers turned out looking just as illustrated in the book. This would be an excellent addition to any cookbook collection.

This is the perfect appetizer cookbook. Others I've tried to use are full of fussy, labor-intensive procedures that turn expensive ingredients into inedible but decorative cocktail 'snacks.' This one, by contrast, has simple, foolproof recipes for finger foods that look and taste great. The book itself is a charming little thing. The author prefaces her recipes with oddly entertaining notes ("Eggs flavored with olives are tasty, and with their vibrant black-and-yellow color combination, they look rather exciting as well") that make it readable as well as useful. I'm hooked on this one, and am giving it to everyone who lives far enough away that I won't be feeding them from it. THIS is where I give the author credit; at home, I'm keeping it for myself.

A well written book. Interesting. Definitely a pager turner.......2004-01-01

This is a 100% trading psychology book. No FA, no TA, but ten chapters or the author's so called principles on trading psychology, which are

1. The market is always right.
2. It's all in your head.
3. You cant prepare enough.
4. Supply and demand rule the markets
5. Commit your thoughts to paper
6. Developing and perfecting your trading shtick
7. Enhancing your shtick
8. Discipline
9. Staying the course
10. On becoming the ideal trader

Though the above can be commonly found in most trading books, the author had done it relatively well by drawing many uncommon analogies, stories, idiomatic phrases that put life into the book. In particular I like his description of successful traders as captains in the oceans, mice in the laboratories and actuaries in insurance companies.

In short, if you wanna read a good trading psychology book, this is it. If you want TA or FA knowledge, look somewhere else.

p.s. The seven cardinal sins of trading in the last chaper is a favorite of mine. They are:-

1. Pride, which challenges the first rule of trading: The market is always right.
2. Greed, holding onto trades hoping for more and more profits while all TA signals are telling you the party is over.
3. Envy, drains positive energy from their psyche, leaving them mean spirited and weak.
4. Anger, that when Greek gods decided to destroy a human, they got him angry and let him destroy himself.
5. Lust, equates to ignoring key defensive rules or self control. The unbridled gambler is the epitome of lust, doubling up after every loss.
6. Gluttony, a lack of focus. Trading becomes obsession They eat and sleep trading.
7. Sloth, that a lazy successful trader is an oxymoron. He or she just doesnt exist.

Exceptional advice from a seasoned veteran.......2003-08-12

I have read other books by Mr. McCafferty and have found this one to be the most valuable, not to mention entertaining. It seems as though most of the newer books out there are just a rehashing of commonly known techniques and offer little valuable insight into how the market actually operates, that is not the case with this fine book. Mr McCafferty seems to understand the way the markets operate and the players in the trading community. He mentions several successful traders and their methods and explains them very well, probably better than those traders could themselves, which is a true testament to his ability as a writer. I learned specific strategies that have changed the way I trade and have been surprised by how well the simple things Tom mentions (and many of us overlook) have worked for me. I can say that I am a more profitable trader because of what I read in this book and for the [$$] it cost me, that is an unbelievable deal. Thank you for unselfishly sharing your trading experiences with us Tom, my life has been enriched because or your words.
