                The Commercial Mediator's Handbook uses a more narrow definition of mediation and addresses the commercial mediator's need for a theory-based, yet practical, guide to preparing for, conducting, and managing commercial disputes.

                Part One draws from several traditional disciplines to provide the theoretical framework. Chapters 2 and 3 introduce systems theoretical framework to commercial mediation. Chapter 4 outlines the most common sources of conflict encountered by commercial mediators, and Chapters 5 and 6 focus on the group and personal dynamics involved in every mediation session.

                Part Two provides a practical outline of the components of a commercial mediation session, from preparation to agreement, step by step, and includes sections that differentiate between positional negotiation and interest-based negotiation along with proven techniques for breaking impasse. Part Three provides practical information about the role players common to commercial mediations: lawyers, insurance adjusters, and experts, and addresses the mediator's ethical considerations.

                Finally, the Appendix contains commercial mediation forms in a ready-to-use format, ranging from scheduling and confirmation letters to a Confidential Mediation Submission and an Agreement to Mediate. The Appendix also introduces and explains the Commercial Mediator's Diagram, which allows the practitioner to conceptualize the parties' dispute graphically.

                This is the first book that approaches mediation of commercial conflicts in a systematic, theory-based way, yet it is easy-to-read and functional. Applying systems theory to resolution of business disputes in effect gives the mediator a new set of tools. The section on identifying interests instead of taking positions is the best I've read since Getting to Yes. Every educator should use this book, and every mediator should read it.

                  First part explains option trading platforms and order routing, and is very confusing. The interviews with option traders in the second part mostly concentrate on differences between electronic trading and trading on the floor. The rest of the book is a very basic description of what options are and what technical analysis is. That's it. Nothing in the book can be used for option trading.

                  This is a very informative book about trading options electronically. The emphasis is on thoroughly discussing different trading platforms and techniques to be used to trade on them profitably. Howard is very strong on explaining different trading methods. I like all his books.

                  People who want to learn about trading options using a computer will do well not to buy this book.In part one this book glosses over options essentials with some of the strategies like straddles explained in just 4 lines.Part Two is filled with one on one interviews with traders which is ok if you are the type who invests after watching interviews on CNBC.Parts Three and four gives a very brief summary of some of the technical analysis methods out there and mentions a few trading psychology theories.It tells you about trendlines but leaves you befuddled about how to apply it.I ended up not learning anything about options but a little about history.I suggest Trade options online by George Fontanills that is an excellent book that is well written and actually gives you websites which is a foreign concept in Mr Abell's book.

                        Good Innovation books typically break down into two categories: consolidators and original thinkers. The consolidators create overall frameworks for innovation and make the overall topic more digestable to the general reader. The original thinkers share new knowledge and insights, focusing on much narrower topics, such as Open Innovation (Henry Chesbrough), Disruptive Innovation (Clayton Christensen), or Experimentation (Stefan Thomke). Chakravorti's book, The Slow Pace of Fast Change, is definitely for the original thinkers. His specialization is the network effect of introducing innovations, how to bring complex products into complex changing market places. For example, introducing the hydrogen fuel cell will require many economic agents and individual behaviors to change. A deep understanding of the dynamics of Network Innovation is essential to bringing certain types of innovation to life. Chakravorti draws heavily on the Nobel-prize winning game theory of John Nash to explain how self-interest guides players in the introduction of such innovations.

                        Unusually for an original thinker, he also provides a reasonable roadmap to allow corporate innovators to find their own path to success. This is not an easy task, but it is better to know the challenges ahead of time and take action. This is an excellent book and deserves serious attention from anyone working on breakthrough innovation initiatives or large-scale business development projects.

                        Many books have been published on the topic of innovation. But as rightly pointed out by Mr. Chakravorti, these studies are successful in nurturing innovations and bringing them till the gates of organizations. Many of the innovations despite being far superior solutions from powerful multinationals, fail in the market place. In other words, technological or product superiority and even the sheer muscle of giant corporations is not sufficient to ensure that these innovations are accepted by customers.

                        This book looks at the market as a network of players with dependencies and in equilibrium. Some entities in this network act as nodes and are the main players. Networks prefer equilibrium and it requires a good understanding of what it takes to shift this equilibrium to a new state. This is where the concept of game theory is extensively used and demonstrated through excellent case studies - Communications, Automobile Industry Supply Chains and Software are some examples. "Think Equilibrium" is the key message.

                        The best part of the book is that it simplifies complexity of theoretical aspects and delivers important concepts and a framework for application by managers. The other book that I enjoyed equally on the topic of game theory in business is "Co-opetition" by Barry Nalebuff and Adam Brandenburger. "How Breakthroughs happen" by Andrew Hargadon and "The Innovator's Dilemma" by Clayton Christensen will be excellent supplements if we need to trace the complete trajectory of innovation from the lab to the customer's lap.

                        This book is a classic. If game theory owes a lot to "A Beautiful Mind", successful innovations in future will thank this beautiful book.

                        5 out of 5 stars Paradoxes of Successful Innovation.......2003-07-18

                        As the subtitle correctly indicates, Chakravorti explains how to bring innovations to market in a connected world. His contributions in this book to our understanding of both the difficulties and opportunities to do so are substantial. Acknowledging his academic roots, he acknowledges that he "developed an appreciation for a first- principles approach to strategy and decisions...how first principles translate into the framing of trade-offs and lead to timely action." Over time, he learned that true insight "comes from connecting the dots across multiple landscapes [and that] such dots lurk in the unlikeliest corners." He allows his reader to recognize those "corners" and to accompany him as he carefully but rigorously explores the connected world.

                        I especially appreciate his dry but delightful wit, perhaps most evident in the final chapter whose head note is a quotation from Thelonious Monk: "You know what's the loudest noise in the world, man? The loudest noise in the world is silence." Without apparent effort, he invites his reader to consider the significance of the Galton-Gould evolutionary pool table, a metaphor which suggests that a market is the polyhedron-shaped ball." perhaps recalling John Nash's insight, he suggests that when innovation arrives on the scene (i.e. in a market), it creates disequilibrium. "It is in this situation of rest [i.e. when the "ball" has stopped] which may be viewed as gridlock by some and as a stable market by others -- that innovations in a connect must pry apart."

                        Given the process of inquiry and exploration which has been completed in the prior chapters, I was intrigued by how Chakravorti achieves at least a temporary synthesis of so many different (sometimes contradictory) factors which interact throughout the innovation cycle: "the eureka moment; the development of technology to give life to an idea; and the creation of an organization to produce and commercialize the innovation." As we all know, few innovative ideas ever reach their intended market and fewer yet survive thereafter. There is indeed a natural selection process during any campaign to bring an innovation into the connected world. Chakravorti suggests four aspects of that campaign:

                        1. "Qualifying the endgame and, in the process, choosing between several strategic options at the outset;

                        2. "Orchestrating the changes necessary across the network of players through a mechanism that propagates the innovator's selective interventions into the wider network;

                        3. "Actively managing with the critical agents that will pass on the innovation's influence; and

                        4. "Making appropriate choices on how to commit to strategies that lead to certain endgames in the face of uncertainty -- depending on the situation, one must choose between making a bet, reserving options, and seeking insurance."

                        Paraphrasing an ancient aphorism, Chakravorti suggests that market imperfection is the mother of innovation because it creates the need to innovate both in terms of a given product or service and in terms of the campaign by which to guide it to market. and then through natural selection to at least temporary security....that is, until another innovation (which accommodates the aforementioned four aspects) eliminates the need for it.

                        I agree completely with Chakravorti that the "slow pace of change is good news for the strategic innovator. In fact, it is essential news." Obviously, when any organization plans to take a new product or service to market, it faces formidable competition and all manner of challenges, only some of which are posed by competitors. (How many innovative products or services have never survived internal barriers which may include what Jim O'Toole has characterized as "the ideology of comfort and the tyranny of custom") In this brilliant book, Chakravorti suggests a number of specific strategies and tactics to help achieve market penetration and eventual success in a connected world. There is also an important lesson to be learned from one of Aesop's fable, "The Tortoise and the Hare": At least in some situations, only a "slow pace" can achieve "fast change."

                        I have never in my life read such an insightful book. It clearly lays out the structure of economics and helps diversify the playing field in terms of market infrastructure. Witty and well thought out, a deserved 5 star book.

                        This is one of the best written books I have read in a long time. The author must have pored over the crafting of every word. It is a serious book and yet it is quite a funny book. Overall it is clear he knows what he is talking about in terms of how real companies act and the game theory behind their actions. And it is about something that most people I know think a lot about. The book is on bringing innovations and new ideas to market. I read it as having much wider social and political consequences because it really does offer a way for us to understand how things work -- or don't -- in our super-connected world. With terrorism and SARS and globalization risks and the proliferation of the internet we are really connected in so many ways. I came away from the Slow Pace of Fast Change with, as the author puts it, a new "mindset" to understand and even strategize in this interconnected reality, where the network is both your best friend and your worst enemy. I know of Moore's law as the rule of the 90s--like everyone else I and everyone else I know lived and breathed it. Slow Pace...will I think give us a rule that may last even longer: Demi Moore's law. Cute, but really quite brilliant if you think about it.
                        Every chapter in the book helps develop a rich set of ideas interwoven with really well-told tales of strategic games among the best known companies in the world -- and even some that have since flamed out, for reasons the book helped make me understand. The tales of real world games among AT&T, the Chinese, WorldCom, Comcast, Microsoft read like a novel. Even though that particular chapter had the least new material in terms of concepts, the stories and strategic analyses alone made its presence more than worthwhile.
                        A deceptively easy read but it's deep stuff. I would read it again.

He spent 12 years settling conflict in court, and has spent the last 19 years teaching business people a less costly, more collaborative way to resolve conflict. Conflict is unavoidable, says Levine, but learning to deal with it in a more productive way is not. In Getting To Resolution, Levine has outlined a step-by-step plan for turning conflict into collaboration.

                              · Get in the right frame of mind. The first essential step to resolving conflict is to want to resolve it. Open up and be truthful. You must commit to and invest yourself in the process.
                              · Stop thinking of conflict as a win/lose proposition. Arguing over who's right often does not lead to a resolution that anyone wants. When you are committed to collaboration, you will disarm those who are committed to a fight. Focus on what the conflict is costing everyone and what everyone can gain from a resolution.

                              Reluctant attorney, Stewart Levine, provides a rational framework to justify spending his life avoiding conflict and confrontation. Even in the business world, he takes a pass on legal action and other logical ways of fighting back in a conflict. Instead, when opinions differ and arguments flourish, he seeks a higher course of reconciliation and collaboration. His seven-step resolution process saves time and money, launders egos, and advances clarity. Although each chapter is summed up almost too tidily in a final paragraph, or even a final sentence, Levine does not stint. In each chapter, he shares real world examples from his life and career. We at getAbstract recommend this book to anyone who wants to rationalize a business deal based solely on trust, to anyone searching for a deal-making scenario where lawyers are not invited, and to people who are looking for the words to express their desire to just get along.

                              One of the wisest sayings in history said that 'one will never know true happiness unless they have experienced true sorrow.' It is this idea that drives our lives, that keeps it interesting and worth living. Conflict is what makes the joys in life so beautiful, but it is also one of the most misunderstood facts of human existence. Conflict is not bound by negative or positive. Conflict is the act of "engagement, learning, creativity and the opportunity for creative value," (xiii) according to Stewart Levine.

                              It is he who wrote Getting to Resolution: Turning Conflict into Collaboration. It is this book that we will now consider. From its definition of conflict to its detailed process on how to turn conflict into collaboration, Stewart Levine simply presents what role conflict should play in each of our lives.

                              Stewart Levine defines conflict as a process of creation and discovery. He criticizes many sects including law, government and other business groups that view a good resolution to conflict as being one sided. Levine argues that a true resolution has not been reached until both sides are satisfied. That is why he has developed a 7-Step model for conflict resolution. It goes as follows:

                              1. The attitude of resolution

                              2. Telling your story

                              3. Listening for a preliminary vision of resolution

                              4. Getting current and complete

                              5. Reaching agreement in principle

                              6. Crafting the new agreement

                              7. Resolution

                              Levine states his points very eloquently and simply, which is his greatest strength. He eliminates a lot of the corporate jargon and disciplined mumbo-jumbo from his rhetoric, which simply leaves the meat of the subject - how to resolve conflict. Levine begins his text by showing the costs of conflict, both physical and intangible. He points out that time wasted in conflict can cost a company or organization thousands, whereas a quick and efficient resolution can move an organization forward at an even greater rate. He then presents a model on how resolution is attained and ten principles necessary to finding that resolution. They include such traits as creativity, vulnerability and responsibility.

                              Later in the book, Levine even presents a short section on where to go to find assistance in resolving conflict. He discusses the law community, not specifically but in a broad sense that shows what could happen in a court setting, arbitration or a mini-trial. Levine also discusses the attributes of an arbitrator or resolutionary as he calls it.

                              All of his definitions and processes make a considerable amount of sense and could be easily applied to every day conflict. Whether in the home or workplace, these processes should be strictly adhered to. When you consider the seven steps above, one can see the obvious need for each. Firstly attitude. One must be in the right mindset in order to seek resolution. Then you must tell your story - frankly and unbiasedly. Next you must listen to the other side and consider possible points of resolution in what you both said. The fourth step would be to clarify your understanding, or becoming current and complete as Levine puts it. Then you reach a preliminary agreement, then solidify it and finally implement the resolution. It is simple and if done efficiently, could take but moments to work through. Levine should be congratulated for his work with this book. Its simplicity and frankness made it extremely enjoyable and with little time to spare, it was nice to take up a book that read so quickly. I strongly recommend this book to anyone who is seeking a more definite way to find resolution in all the conflicts of life. Ultimately, finding that resolution will make your life more gratifying and complete.

                              The books "Getting to yes" and "Getting past no" gave me hope that I could take steps toward an agreement with my daughter's mother, instead of mearly waiting for the lawyers to work toward an agreement or waiting for time to heal the wounds we both inflicted on each other.

                              When I read reviews for this book, it seemed like maybe I could also get some more ideas of how to resolve our conflict, and this book seemed to be pointed more at a conflict such as mine instead of the business and international conflicts addressed in "Getting to Yes" and "Getting past no". So, I got it and discovered that the above two books seem to give a better road map toward resolution.

                              I suggest not buying this book, but buying the other two that I mentioned. THEN, if you have $15 to throw away, buy this book.

                              Having worked for 475+ lawyers in 3 states and the District of Columbia, I've seen the critical need for the insights in this book.

                              Too often, people with disputes want to place blame or take revenge rather than find a way to be whole again. Particularly during my tenure as a paralegal in family law, I saw how the legal system fanned the flames of pain and frutration. This wasn't just a waste of time and money -- it made the pain worse.

                              Stewart begins by having people tell their stories, then grieve, create an attitude of resolution, and work from a vision of healing. It's powerful, but it's also practical.

                              I're recently recommended the book to family therapists because it lays out practical methods for dealing with disputes among parents and teens. I cannot recomend this book too highly. Now I would like to see more. When is the sequal coming out?

                              A social statement in social abuse married to a white collar crime; criminal greed and behavior finds ignorance in exploitation by greed ethics and this book reveals the conclusion in real life.
                              Adoption or abortion the question of life or death for the unborn in a poverty uneducated circumstance.

                              A Pregnancy resulting from looking for love by Life's throwaway abused child/girl/woman.(The seed donator was a Texan from the panhandle; a Pisces named Chris Swift, a married liar with three kids)

                              The unmarried pregnant female with no social or family tools with which to survive wounded unwanted, existing through a life of abuse misuse exploitation and humiliation, a 10th grade education. Contacted a trusted (unknown to her) unethical attorney (exploiting) dating her beautiful damaged sister to arrange for a direct(not private) adoption.

                              Trust in a professional who only saw this adoption as a way to make money under the table. Trusting is the 1st requirement in exploitation of adoption. The requirements for the future parents (designated from the Ozzie and Harriet TV parents). They both must have college degrees; both religious, a settled 30ish older childless couple whose unmet desire for a child spanned a long time. If the couple could not be found then forget the adoption. The pittance of cash she was able to borrow and live on was to be paid back; medical cost covered.
                              The attorney was to insert into the adoption paperwork, medical contact information, if the baby should ever need a body part the girl was available. To tell the parents the child was loved but for her future health and welfare could not be kept.
                              (the problem culminanted with the unethical attorney; a thief who sold the baby to the highest bidders; a young couple unable to pass regular adoption channels; the unbornchild/unwedmother were exploited for money).

                              At 12:30 a.m.on the night of birth the laboring terrified christen girl(baptized 4X before turnig 10 years old) was dropped on the outside steps by a sister going out for another night of drinking instead of staying with her youngest sister at the dark forbidding catholic hospital. Her clicking heels underlined her abandonment, the tall safety haloed lights revealed the mist of baby rain drops tears from God.
                              How ironic the rain, alone, the silence.

                              The nurses/nuns led her to a curtained examining rooms, voicing disapproval of the unwed pregnancy. Led her to the high bed then walked off. Another laboring woman filled the air with screaming and yelling; the screaming singing mix in echoing voices with gleeful shouting of winning from a poker game. Two or three times someone stuck a shadowed head in and a you ok, the girl begged for the bathroom, the head dismissed her with a disrespectful shrug and tone use the bed pan.

                              The pain was great and one of old familiarity a friend, she refused to scream accomplishing it by biting holes on the inside of her mouth, the salt taste diverted her attention a trick learned from her father's training sessions to retain silence. The pain teacher the lesson circling and riveted around her solo universe.

                              No one ever told her anything; certainly not about labor, only that look wait until you find out, the huge scare. she could handle this too alone like everything else; by herself with no one to support or share it with except the unamed demanding entrance into the world.

                              The girl used her hands, arms, and legs to intertwine in the antique bed railing her body hung slung sideway not on the bed at all now the pain eased dangling sideways from the railing the tiredness of clinging to the rail filtered awareness of the throbbing white hot pain enveloping her being.

                              Dawn of light stabbed from beneath the heavy curtains, shift change, new nurse, new attitude, Aw honey untangling the twisted girl from the rail, explaining it's accepted that a bed was messed in and not a shameful act. Then checked the progress yelling Oh my god! this girl is having a baby after touching the crowning head.

                              She was perfect in everyway, a full head of hair and delicate soft strong hands with long fingers. A quiet baby with large eyes. BEAUTIFUL. She was going to have a better life than the birthmother that was her two gifts life and a future.
                              (unknowning of the transfer of large sums of money; the young non-degree parents using this baby to save a shakey marriage; the future blackmail to the young parents)

                              The extended painful delivery created by ignorance of the girl accompanied by action judgment to a sinning unwed mother by the religious judgmental uncaring night staff.

                              The unethical attorney flew from Tucson paid the bill; took the bundle with a nurse to fly to Boston where the two Professors at a university were waiting for their child.
                              That was his story to the birthmother.

                              The baby grew up and wrote this book mad at her birthmother, mad at the parents who paid for her, mad at the world for not having the life she wanted.

                              Truth is relative. To parties involved.
                              Everyone should know their birthright.
                              That information was "SUPPOSEDLY" given with the baby's papers at transfer; but since it became a lucrative shaded adoption; a purchased adoption the attorney's closed it and removed any information to the birthmother.

                              One can only hope writing Explication releases the author from the past. The future is bright and fertile and the past should be used for learning.

                              Truth is create by ones view and is whatever one makes it.

                              I think anyone thinking adoption and trusting the professional system should read this book.

                              Very creative in Jennifer Bryan using her monetary judgement to purchase the internet tools to create her internet company and assist in the creation of an online publishing company to make her an author of this book.
                              A podium to damm the people she judges have treated her badly.

                              As one who never aborted; I always looked for the best solution in unforgiving circumstances as adoption.
                              Life instead of death.

                              My personal experience has changed that fundamental belief.

                              Adolesent ramblings of a disturbed young woman. With help all around the author wallows in self pity, and wants to Know why no one loves her for the ungrateful, shaved head, spiteful, pill popping,alcohol drinking, manipulative, promiscuous, runaway she admits she is. This poor woman needs therapy and I need my head examined for buying this book.

                              Adolescent ramblings of a 30 something woman. I can't imagine this book providing insight to anyone. One thing that is obvious, is that this woman needs to start taking responsibility for herself, and stop blaming her adoptive parents, her birth mother, the school, the Hospital, etc. It will probably take a chunk of therapy. This woman has issues! This in not your typical adoptee.

                              Not your basic Oprah-like happy reunion of adoptee and birth-family, this book details the very rocky and painful teen and young adult years of an adoptee as she searches for her identity and hopes to find it with her birthmother.

                              Jen allows us to peek into the mind of a teen suffering genealogical bewilderment, a syndrome experienced by adoptees. In Explication, we share with Jen through her painful teen years, the joy and loss of her first love (a fellow adoptee), and the reunion with her birthmother and birthsisters.

                              A compelling read, neither my daughter or I could put the book down. I highly recommend this book, whether you are an adoptee, a birthparent, or just looking for a good read.
